About the service

In this service, we aim to provide a comprehensive end-to-end solution for appeals before the GST Appellate Tribunal—from drafting to filing and representation. The service is divided into the following segments and charges may differ according to the segment chosen:

 

1. Drafting of Appeal

Upon receipt of the impugned order, show cause notice, and payment of initial fee (₹ 1,000), we will first study the legal feasibility of the appeal, including maintainability, limitation, and merit of grounds.

After the preliminary review, our team will discuss the strength of the case and possible grounds of appeal with the professional or client via email or phone.

Once the client confirms to proceed, the balance fee shall be payable, following which the draft of appeal (Form GST APL-05) shall be prepared.

The draft will include Statement of Facts, Grounds of Appeal, and Prayer, supported by legal references and judicial precedents.

Revisions or modifications suggested by the professional/client will be incorporated before finalization.

2. Compilation of Supporting Documents

Preparation and indexing of annexures, evidence, reconciliation statements, working sheets, and other supporting documents as per the Tribunal’s requirements.

Assistance will be provided in certification and attestation of documents, if necessary.

Charges will vary depending on the quantum and nature of documentation involved.

3. Online Filing & Physical Submission

The finalized appeal shall be uploaded on the GST Appellate Tribunal portal and a copy of acknowledgement will be shared with the client.

A complete set of papers, duly indexed and bound, will also be prepared and dispatched physically for record or submission if required by the Tribunal.

Compliance with procedural rules, pagination, and alignment of annexures will be ensured to maintain the professional presentation of the appeal.

4. Representation before the Tribunal

Representation before the Tribunal Bench (online or physical) will be undertaken by our experienced professionals on behalf of the Appellant or representing professional.

During the hearing, additional grounds or clarifications may be presented to strengthen the case.

We ensure effective advocacy and presentation, based on deep understanding of the case facts, legal provisions, and judicial precedents.

In case of physical appearance requirements, customized packages shall be offered.

Appeal FAQs

  • Yes. Any person aggrieved by any order or decision passed under the GST Act(s) has the right to appeal under Section 107. It must be an order or decision passed by an “adjudicating authority”. However, some decisions or orders (as provided for in Section 121) are not appealable.
  • For the aggrieved person, the time limit is fixed as 3 months from the date of communication of order or decision.
  • Yes. He can condone a delay of up to one month from the end of the prescribed period of 3 months for filing the appeal, provided there is “sufficient cause” as laid down in section 107(4).
  • Yes. He has the powers to allow additional grounds if he is satisfied that the omission was not wilful or unreasonable.
  • The full amount of tax, interest, fine, fee, and penalty arising from the impugned order as is admitted by the appellant and a sum equal to 10% of the remaining amount of tax in dispute arising from the order in relation to which appeal has been filed. On making the payment of pre-deposit as above, the recovery of the balance amount shall be deemed to be stayed, in terms of section 107(7).
